i'm bill o'reilly. remember, the spin stops here because we are definitely looking out for you. breaking tonight in the middle of a two-day debate over the obama care website, how well it is working and whether we should trust the administration's claims, one top republican senator now levels an explosive accusation. welcome to kwoez kelly. i'm megyn kelly. as the obama administration say it is website is greatly improved new reports point the to a major flaw. the part of the system that's supposed to deliver customer information to insurance companies, you log in your information and they deliver it to the insurance companies to get you insurance -- still doesn't work. that mean s many people may not be able to get coverage and others may think they have it and will find out at the

hospital they don't. while the administration officials defended the improvements they claim they made to health care.gov the number two republican in the senate lashed out in an online chat with voters and is getting national attention tonight for this. >> i think the current administration the has take en lying to a new level. to me, that's the one thing that i find most aggravating about what's happening in washington these days. particularly about this administration which is a lack of accountability. and the willingness to mislead people or provide them false information and expect to be able to move on. we have seen that most recently in the health care debate over if you like what you have, you can keep it. something that we can go back to 2010 and demonstrate that the department of health and human services knew was false. >> ed henry, our chief white

house correspondent with the latest. >> i have reached out to white house officials tonight to react to the senator. they have not chosen to do that. if they do, we'll update. what he's doing with the comments is cutting to the heart of the debate an issue of credibility. that's why we have seen the president's approval ratings plummet in a series of polls in recent weeks on the issue of do you find him trustworthy. that's something earlier in the presidency he was strong on, even despite opposition on his policies. he was strong on that no longer. he's under a lot of fire over that. on the website today because health care has been a part of that. over the weekend the administration said they met the self-imposed deadlinele to fix the site for the vast majority of users. today administration officials confronted with the fact that a bunch of online users were building a new page that said, okay, we have your information. you have been put on another page. they are insisting it's not an error message that people are in a line and they will enroll.

but the question remains, are they just being moved from one waiting line to another? then you have the fact that the insurance industry today sent out a warning basically saying that they think there are problems with the back end of the system, the checkout line, if you will. that information you share with the insurance company you mentioned and some people may not be able, though they put their information in may not get insurance by january 1. here is an insurance industry spokesman. >> what everybody wants to avoid is a situation in which consumers think they are enrolled but their enrollments weren't processed. they weren't able to pay their first month's premium and the coverage isn't beginning on january 1 as they thought. >> jay carney said agents have been reaching out to people trying to enroll telling them, you have to get the first check in. do all the paperwork, get it in so you can get your insurance bien january 1. he said they are confident they could get it done. when pressed specifically, if people get the information in by

december 23 which is the cut-off date, will they have insurance on january 1? can you assure them? he would not answer that. they have had hiccups before. they would have to watch what they say. >> how is he pressing people to get a payment in if the website doesn't work? how do they issue a payment? >> how do you get the check in if it won't be processed, if the information goes to the insurance industry. jay carney and secretary sebelius tried to say millions will get insurance. this will work out. we are turning the cover. they are still confronting tough questions. >> how do they get insurance if you don't pay for it? ed, thank you. >> thank you. >> what sense does it make to make the paying part is hardest part now? is that going to encourage enrollment? as ed mentioned after the talk about getting people onto the health care.gov website the bigger problem may be getting them covered. marc thiessen joins me. he's a former speech writer for president george w. with bush.

shouldn't paying be the easiest part? >> you would think they would want your money. we are not geel diehling with the private sector but government. the senator is right. they continue to lie about this. just this weekend they said the website is working -- this is a quote -- with private sector velocity and effectiveness. they said that. unless amazon.com works 90% of the time, is under maintenance, doesn't transmit your information and has an online waiting room where you can park until they have capacity for you to shop it is not working with private sector velocity and effectiveness. think about the 90% figure. they said it works 90% of the time when it's not under maintenance. they don't say how long it's under maintenance. they might have well said it works when it doesn't work. it's meaningless. >> you never get your christmas gifts on amazon if you don't pay. you have to pay.

>> exactly. >> in the private sector, be quiet, judge. it's not your segment yet. you have to pay before they will give you the product. the truth is people could be showing up at doctor's offices and hospitals in the new year only the to then find out they the don't have coverage. they found out they couldn't pay and something else happened. >> it's hard to pay when you haven't purchased an insurance policy. part of the problem is they are selling potemkin insurance policies. they fixed the user interface where people go on the site. >> sort of fixed. >> sort of, yeah. well, give them credit that they fixed it but it's still crashing a little bit. the back end that transmits information to insurers isn't working. they have a lexus with a lawnmower engine. i didn't go anywhere. you have insurers getting called, deluged with calls from consumers saying, i want to talk about the insurance i just bought. they say, we have partial

information. how can they pay for it if they haven't signed them up for anything? >> how will it manifest itself? >> the administration claims this is not a law problem. the it is a website problem. >> yeah. >> as soon as we get it up and running and every day we make improvements people will see the wonderful products we have to offer. they will run to the websites, buy the product . and that will solve all of the problems. >> yeah. it's not the problem. the problem is the law. look. the problem is they have 5.6 million people who have lost insurance that they have to sign up in 23 days in order to not have millions without coverage on january 1. that's 240,000 a day for the next 23 days. even if the website worked perfectly it's almost impossible. the next year you have 50 million people who will lose their employer-based coverage. if people are mad about 5.5 million, how will they feel about 50 million next year?

obama's lost his trust and credibility. fixing a website will not repair the bond of trust he's broken with the american people. >> we'll have the other side with ben le bolt on the issue coming up. marc, thank you. >> thank you, megyn. >> a powerful house committee holds hearings that will challenge the president for failing to uphold his constitutional duty to enforce the nation's laws. our next guest says the effects of the t president's actions rises to the levels of an impeachable offense. let's table that. it's a hot button word. >> yes. >> they are having a congressional hearing about whether the president violated his duty. whether he's stepped beyond what he's capable of doing as the chief executive of the country. is that so? >> the committee is looking into whether the president t substituted his judgment for that of the congress's in such a way that he's enforced a law

that congress didn't write because he rewrote it. >> okay. >> we're both lawyers. presidents have some discretion. they can go easy on people on prosecution. they can go aggressively on other people. when the president decides not to prosecute a large group of people and says in order for me not to prosecute you, you must do a, b, c, and d. and it's not in the statute. >> are you talking about a legal the -- >> yes. >> we are talking about health care.gov. >> well, the president decided to give exemptions from the application of the law to certain groups and not others. he can't do that. >> that's an administrative decision. isn't it true the president and the executive banch has the authority to exercise discretion in the enforcement of the law? >> not when they contradict the law. when the law says it shall take effect on a certain day and everybody on a certain day has to have the cadillac policy whether they want it or not, whether they can afford it or not, the president can't change

that. >> timing decisions have typically fallen within the purview offings as charged with enforcing the law. that's what the president and his supporters are saying. this is to delay the employer mandate, take care of individual insurance agencies. it's a timing matter. >> when he says the uh law shall take effect on a certain date and insurance carriers prepare for that certain date the president is without authority to change the date. he may suggest it be changed, ask bureaucrats to change it. it's a decision to be made by many people. >> let's entertain for the discussion that you are right and the president committed a violation of his oath to faithfully execute the laws of the country. what's the remedy? you say impeachment, but can you go to court and challenge him? can you try to impeach him? >> i don't think the president of the united states will be

impeached for this because of the experience we had the last time when bill clinton's eye was off the ball because he was -- >> backfired against the republicans. >> of course. it backfired against the country because he wasn't paying attention to osama bin laden. nobody wants to go through that again. when you have a president who is not faithfully enforcing the laws, who is frustrating the will of the congress, who is doing the opposite of what congress wanted, that republicans in the house will look into it and may enact a resolution that points out he's doing that. will it lead to impeachment? i don't know. it will diminish and destroy the trust he had with the american people. >> dicey political move for the gop. judge, good to see you. >> my pleasure. >> that was your segment. >> you said was hilarious before. >> you're not allowed to sit in the a block anymore. >> love ya. >> we are not done with this accusation tonight making news from the number two gop --

from the world headquarters of fox news it's "the kelly file" with megyn kelly. >> growing fallout tonight after a former senior adviser to president obama advises americans to wait just three more years before obama care starts performing the way the administration said it would. here's david plouffe. >> it's a fact. it may take until 2017. every state will be running exchanges and expanding medicaid. i think it will work well then. >> karl rove is a fox news contributor. to steal a line, "we'll look forward to that, greg." 2017, karl. he's talking about medicaid, not the law. but there is a lot of people going on the medicaid roles under the law now.

>> more than anticipated. when you look at the relationship, they anticipated for every one person added the to medicaid they said one person on the private insurance market. that's not working. there are more people added. in oregon 52,000 people being added to medicaid, zero on private insurance. this was happy talk. this was going on, bubbling, looking excited but it was happy talk. we passed the the law three years ago. we have complete lly screwed up. wait three more years and we'll be out of office, so you can't blame us anymore. >> they say it's a website problem, not a law problem. >> no. >> the website is on its way to being repaired. that's the party line. >> this is a law problem. this law is terrible. it will get worse. they estimated 2 million people

would lose their coverage. >> turn it so we can see it. >> 2 million people would lose their existing coverage in 2014. we already have 6.4 million policies. there are probably 10, 12, 14 million people who lost coverage. 200,000 have apparently been enrolled through the end of november. so for every one person who's enrolled we have 32 people losing their coverage. that's a bad trajectory and it won't get much better. subsidies. one of the reasons they think it will be popular is because people will have coverage subsidized. their estimate next year was for every eight who signed up 7 would get a subsidy and one would not. thus far of the people who signed up, for every one person who is getting a subsidy, three are not. for those who have signed up on the federal exchange, for every one person who has a subsidy, about two and a half have not. their insurance is becoming more

expensive in all likelihood. higher deductible and higher premium. finally, 2017, by the administration's numbers how many people will be uninsured in 2017? 30 million. mr. plouffe can go on with happy talk but the american people know differently. when the administration talks one way and the reality is felt a different way, it hurts. >> let me talk to you about the second to last line. the number of people getting subsidies. in my conversations with the key architects of the law, david cutler, he explained the to me that they genuinely believe that if people could get on the website that they would see the great policies that are cheaper, he says, in most instances because of the subsidies. i said, well, if that's true, why are we getting reports of people not qualifying for a subsidy and having to pay more money. he said that genuinely confuses him. when he sees it for a younger people he understands it.

when he sees older people paying more he said that's unusual to him. they didn't expect it. they expected those people to be subsidized. >> look, 87.5% of the people who are signing up were expected to get a subsidy. if you look at the number on the state exchanges it's 23%. for the federal exchanges it's under 30%. it's well below what people anticipated, what the experts who advised the law anticipated. there are perverse things to drive up costs like essential benefits which adds provisions and benefits and coverage that people don't want. there is a tendency to not only increase the premium but to increase the deductible so people have a higher out of pocket expense. >> i have to run but i want to get this in. debbie wasserman schultz claims democrats will run on obama. she has both arms around it with

a big bear hug. is that real or spin? >> i'm afraid it's spin. i pray to god it's true. as a republican i ep hope nempb the democratic party who is a candidate follows her advice to put this at the center of the campaign. former speaker nancy pelosi believes that as well. i hope when the administration encourages democrats to make it the centerpiece of their campaign if they voted for it, they ought to stand up like mary landrieu from louisiana said that she would vote for it again in a second. i hope they do it. that will lead to defeat in november. >> thank you, karl rove. >> you bet. >> we have seen polls showing america is losing faith in the government. there are worries we are also losing faith in each other. michael reagan is here on why it matters. new video on why this black friday came with more than one shopper bargained for. trying to hold onto her sale on television. in ft. worth, texas. people also went crazy. look at this. knocking over each other along with dozens of display cases. the cops again had to come in and calm things down. on twitter, they started calling the stores brawlmart. at the franklin mills mall outside philadelphia, two women start fighting. knockdown dragout fighting. one has a taser or a stun gun. listen to the zaps followed by the guy who took the video. play it. to a new level. >> i think the comments were misguided and unfortunate. i think republicans have been rooting for the failure of the affordable care act rather than taking steps to strengthen it. the p president apologized to the american people for saying that if you like your plan you can keep it. i think that was refreshing that something that americans didn't see from the prior administration when there was a credibility issue at stake -- >> he didn't really apologize. he said, i'm sorry people are are finding themselves in this situation because of something that i said. le. >> i think what he should have said is many plans in the individual market are inadequate. they drop your coverage if you get sick -- >> let me stop you there. we have had the debate about what the president should have said. what senator cornyn is saying is that it was all lies, that this administration has been misleading and there is no

accountedability. you were with barack obama for 2012 helping to push his re-election and health care was a major issue. >> right. >> were you present for discussions about this line about people being able to keep their health insurance plans. >> i worked for the president beginning in 2007 through the re-election campaign. we tried every day to get everything we said and that the president said right. it went through a research vet, a policy vet. >> did you think you would get something wrong? >> we were scared we would get everything wrong. >> you're not answering my question. there have been lots of reports about barack obama's advisers and so on being present and whether the policy people, the report from the wall street journal was that the policy people said the president can't go out there and say this if you like your plan you can keep it. and the political people said, keep your mouth shut because your actual statement is not

that salable. that's what the journal reported. >> i never discussed it with him. i don't recall having that discussion. having talked to some of the other people involved subsequently, i know there is an incredible amount of churn and change in the individual health care market. these plans change over year after year after year. what republicans have tried to do is blame the affordable care act for all of the inefficien inefficienciinefficienc inefficiencies. we preserved the private market. the pre-existinging market. >> the head of the insurance group, karen ignami, forgive the pronunciation, said the reason the policies are being cancelled is because of the affordable care act. insurance companies in partnership with the white house and administration on this specifically say the reason the policies are being cancelled is because of obama care. >> they were weak policies that now need to meet a higher standard. they can't kick people off anymore. >> you can't keep saying that. >> because of a pre-existing

condition or a lifetime cap. they have to meet a higher standard. >> you're dodging it. >> i'm not. >> you are. >> americans that were being dropped will be offered stronger plans. >> why are they being dropped? >> 70% of people on the individual market will qualify for subsidies or medicaid coverage. >> why were they being dropped? it goes back to whether it was a lie. the president said if you like your plan you can keep it, period. now the insurance companies said that's not true. the only reason we are dropping people is because of obama care. your response is, those were crappy plans. >> the president acknowledged that statement didn't communicate what he wanted to communicate. >> but was it a lie? >> it gives people the opportunity to enroll in stronger plans and the president addressed that and that he misled people. the administration is working every day to regain credibility. the test will be are people

satisfied with the plans. four times the number of people who signed up to enroll in october signed up in november. in states that set up -- >> 27,000 in october. >> but the reports today said 100,000 now. we have seen a lot of success. >> i realize that. but you are trying to get 7 million by march. let's not lead the viewers into thinking this is a big number. >> that was the congressional budget office projection. the goal for the administration is to make sure the right set of people enroll to keep premiums down to make sure the majority of people see lower premiums like the congressional budget office directed. >> we talked about that's key. people have to get on health care.fwrks ov, see lower premiums or subsidies. that could help a lot if it happens. >> eight. >> let me ask you about this issue of credibility. david plouffe came out and said, look. the people trust this president. right now the latest poll suggests not really.

the majority don't or it is extremely close. your partner in this strategy firm is robert gibbs. he was formerly the white house spokesman. he's come out and been very frank about his belief that this administration needs to hold someone accountable for the deterioration and trust we have seen. somebody needs to get fired basically. you agree with that? >> he has. i think ultimately we'll see accountability here. the real accountability is have we put in place a system that ensure that is the program works? >> so, it isn't. come on. you don't believe that. >> they have brought in tech experts from silicon valley. >> stop it. come on. >> a world class management expert to make it work. they are taking steps to ensure accountability. >> stop that. you are too smart to believe that. real accountability is when a disastrous rollout is turned around and the system is working beautifully. i'm asking you about accountability for the disastrous rollout. >> what would you like to see, megyn? how do you define it?

>> i don't care. it's not up to me. don't tell me accountability is to fix the mistakes. accountability is to say you screwed up and here is the person. i don't know who it is. is it kathleen sebelius? you tell me. is it the person who runs medicare and medicaid? >> i don't think it will come down to any one person. there were 55 contractors involved in developing this. >> who was their boss? >> 55 contractors were involved in the first place. >> who was their boss. one of the architects -- >> came on and charged the management. >> let me get this in and i will give you the floor. one of the architects said -- and you know this. he wrote a public letter in 2010 to lar ray somers and said, listen, i want obama to succeed. you have to have a ceo running this thing. i don't think the people advising the president, we can count on them. i see disaster coming. he was blown off. the question is whether there should have been a ceo and who

as i think president reagan said. >> speaking of president reagan, his son michael is the president of the reagan legacy foundation. the polls show that one-third of americans now say most people can be trusted. in 1972 half of the country believed that. now two-thirds say you can't be too careful dealing with other people. does this matter? >> i think it does matter. i was thinking about it, will being to the set-up with the piece and what have you. in 1983, 84 you didn't have these in the room. now if one is in the room it's hard to trust the room. ask mitt romney, prince harry and alec baldwin. i think people today want the to trust what they are putting on facebook is only going to be seen by friends but the reality is they are finding out it's seen by more people than their friends. people want to trust they can

give their information to a health care website. they don't want it hacked. again, there is no leadership like there was in 1983-84 which you played with my father of people talking about trust. talking about the greatness of america. being a cheerleader. there are no cheerleaders out there now. one of the problems is we haven't caught up and matured with the new social media operation that's going on in the world. my daughter ashley. people text her to say, let's go out for a date. she says, call me. the reality is we text and e-mail and don't participate in active real conversation. >> abc news this report. they talked to robert putunanimous who did "bowling alone." he talked about our declining social capital. speaking of our iphones and tablets he says we have less

socializing, fewer community meetings, fewer weeknights out bowling or down at the vfw. and more of this, this, this. it's led to a social isoladecre have in one another. what do you think? >> absolutely right. my wife gets on me. so i try to stop taking my phone to dinner. how often do you go to dinner and see people on iphones or droids instead of speaking to the person across the table from them. and having active conversations. >> do you think -- >> how come? >> do you think there is a role for politicians to play here? the piece talks about the distrust in washington and of our leaders. starts at the top and continues thereon. >> listen, way before barack obama said you can keep your insurance, period, there was congressmen saying, listen, we'll have a law on drugs. then you find out they are drug
